The Judiciary announced on Apr. 16 that some creditors have received letters and emails from a company called Public Digital, which offers to file a proof of claim for a one-time fee. The Judiciary said this offer may be misleading.

This issue is important because creditors do not need to pay anyone to file a proof of claim in bankruptcy cases. There is an official online tool, ePOC, available for free use on the U.S. Bankruptcy Court for the District of Colorado’s website.

According to the Judiciary, “You do not need to pay anyone to file a proof of claim. Creditors can file a proof of claim for free using our official online tool, ePOC, which is available on our website at https://www.cob.uscourts.gov/proof-claim.” The statement urges creditors who have questions or concerns about such solicitations to contact the Court directly.

No additional background information was provided regarding previous incidents or actions taken against companies sending similar solicitations.

The Judiciary’s warning serves as a reminder for creditors to use only official channels when filing claims and avoid unnecessary fees.
